Euro-Patent Soul Searching

The European Commission (EuroCom) is seeking to find the true meaning of patents. Out for tender to contractors is an RFQ for a study on the "strategic use of patents".

In EuroCom's own words:

This study is meant to further advance theoretical and empirical insights on the strategic use of patents in the European Union from a competition, enterprise as well as welfare policy point of view. The aim is to provide a reasoned estimate of the importance of the strategic use of patents for the European economy and the identification of conditions that render sectors more susceptible to anti-competitive uses of patents. In a further step, the study should provide proposals how to prevent anti-competitive uses of patents while securing an adequate reward for innovative undertakings.

EuroCom could start by reading the Patent Hawk primer on Patent Economics. Then they may want to realize that, as a fundamental dynamic, patents act as a propellant to technological progress, something recognized on the Continent since the 1400's. Finally, rejoice in the commoditization of intellectual property.

Most importantly, EuroCom should pull its head out of its "prevent anti-competitive uses of patents" mentality. What exactly do they think a patent is supposed to do?
