Time Warner Strikes Back

Late week, USA Video sued Time Warner for infringing 5,130,792. Now Time Warner retaliates, seeking declaratory judgment of non-infringement in Delaware district court.

'792 claims a method of video on demand (VOD), transmitting compressed video from a central server to a receiver over a network. The problem with '792 claims is in specifying a "telephone network," not broadband.

USA Video was set back early last week when the Federal Circuit halted the company's attack against MovieLink, a joint venture of five Hollywood movie studios, by affirming a Delaware district court summary judgment of non-infringement. Dusting itself off, USA Video then went after Time Warner, Comcast, Cox and Charter for infringing '792. Time Warner may be hoping for Delaware deja vu.
