Qualcomm Denied
On
Friday, the ITC denied Qualcomm's request to stay its ban on importing Qualcomm
cell phone chips. Qualcomm's only hopes are an unlikely emergency stay from the
appeals court (CAFC) while waiting a presidential veto of the ban.
According to Smith Brittingham at Finnegan Henderson, the CAFC doesn't have much of a history of staying ITC exclusion orders pending appeal. Brittingham considers a Bush veto of the ITC ruling "an uphill battle, despite the publicity they're getting."
