reading for those interested in the notable docket of rocket, the Eastern
District of Texas, in this week's
Texas
Lawyer. With 232 patent cases filed in Marshall in the past year, trial
dates for filing there are now running to 2012. Judge T. John Ward's patent
litigation mill is slowing, but faring.
Tyler, with 70 filings last year, is faring better, "going to trial within 24 to 30 months after they are filed." Judge Leonard Davis of Tyler said he has about 100 cases, a manageable caseload. "Our rocket is still flying high," Davis crowed.
The sad fact is that other districts don't replicate the formula. Michael C. Smith, renowned Eastern District of Texas blogger: "Generally, I assume they're going to want to go to one of the quicker venues. But to my surprise, they prefer to go to Marshall, where the judges have the expertise."
