On
patent reform, the Senate shoots first and ask questions later. Judiciary
Chairman Patrick Leahy hustled his cockamamie patent bill out of committee in
April on a 15-4 vote. Now judiciary committee member Jeff Sessions is
wondering what impact the proposed post-grant challenge process might have.

Who is paying Leahy?

Post grant review is a bad idea and will be the first step in dismantling our great system. Imagine a large company like, say, IBM, or Microsoft, tying up patentees (whom they will call trolls) in an endless series of post grant reviews.

Pretty much happens right now, with reexams
post grant reviews would be last nail in the coffin when combined with damage apportionment and other clever tricks Leahy was paid to implement
